Idaho nonresident insurance producer license
Last updated
An Idaho nonresident license lets a producer whose home state is elsewhere sell in Idaho. Resident and nonresident licensing is on the Idaho part of the exam too, citing Idaho Code 41-1003(9), 41-1009 and 41-1010. [1] Here is what the law and the Department of Insurance say.
The five conditions (Idaho Code 41-1009)
Unless denied under 41-1016, a nonresident applicant receives a nonresident producer license if: [2]
- they are currently licensed as a resident, and in good standing, in their home state;
- they have submitted the proper request for licensure and paid the fees set by rule;
- they have submitted the application they filed in their home state, or a completed uniform application instead;
- they have submitted fingerprints, if the director requires them; and
- their home state gives nonresident producer licenses to Idaho residents on the same basis.
The director may verify the producer's licensing status through the national producer database or by any other acceptable means. [2]
Which lines you can get
The Department's instructions say only the lines of authority listed on your home state license can be applied for in Idaho, and that a CRD number is required for Variable Life and Variable Annuity. The first step is to hold an equivalent license in your home state or designated home state. You then apply through NIPR. [3]
Fees
Idaho's fee rule sets the original application fee for producers at $80, and the biennial producer renewal at $80, or $60 if renewed electronically. [4] The rule also says all fees and miscellaneous charges are non-refundable except as noted, and the Department's instructions repeat that all fees are non-refundable. [3] [4]
Renewing as a nonresident
The Department's renewal instructions say a nonresident cannot renew if the lines of authority on the home state license and the Idaho license do not match. Licenses are renewed as is: you cannot add or remove lines during renewal. [5]
Address changes and moving
- Contact changes: the Department says nonresidents must change their contact information in their home state first. Idaho will not change an address in NIPR that has not been changed in the home state. [6]
- Moving states: a nonresident who moves from one state to another, or a resident who moves out of Idaho, files a change of address and gives certification from the new resident state within thirty days of the change of legal residence. There is no fee for this filing. [2]
Service of process
Idaho Code 41-1010 covers service of legal process on nonresident producers. [1] The Department's fee rule charges $30 for receiving and forwarding a summons or other process served on the director as process agent for a nonresident producer. [4]
