Terms of Service
Effective date: October 19, 2026
Version: 1.2
These Terms of Service ("Terms") are a contract between you and Novametrics WY LLC (Prep Retention) ("Prep Retention", "we", "us", "our"). They cover your use of https://prepretention.com and everything we offer through it (the "Service").
Please read them. You accept these Terms by checking the box that says you agree and then creating an account or completing a purchase. If you do not agree, do not use the Service.
Some parts of these Terms limit what we owe you if something goes wrong. Those limits apply only as far as the law allows. Nothing in these Terms takes away any right you have under a law that cannot be waived by contract, including consumer protection laws of the state where you live.
1. Who we are
The Service is operated by Novametrics WY LLC (Prep Retention), which sells access to you. Your payment is processed by our payment processor, Square (see section 7). Your use of the Service, and what we owe you for it, is governed by these Terms between you and Novametrics WY LLC (Prep Retention).
Mailing address: 30 N Gould St #69865, Sheridan, WY 82801
Support: support@prepretention.com
2. Who can use the Service
- Minimum age 14. You must be at least 14 years old to create an account or use the Service. No one under 14 may use it.
- Ages 14 to 17. Users aged 14 to 17 may use the Service and make purchases.
- How we check age. When you sign up, you enter your birth year and confirm it is true. We do not ask for ID or photos and we do not verify the age you give us. We rely on what you tell us, so you must give your real birth year.
- You must give us true and current information when you sign up and keep it up to date.
- Under 14. If we learn that a user is under 14, we will close the account and give a full refund of any purchase. If we learn that a user is under 13, we will also delete their personal information, as described in our Privacy Policy.
3. Your account
- One account is for one person. Do not share your login or let anyone else use your account.
- Only one device can be signed in to an account at a time. Logging in on a new device signs out the device that was signed in before.
- Your account is for the state you chose when you signed up. It shows only that state's products and practice content, and the state cannot be changed later.
- Keep your password private. You are responsible for activity on your account that you allow or that results from you not keeping your password safe.
- Tell us right away at support@prepretention.com if you think someone else has accessed your account.
- We may suspend or close an account that shows clear signs of sharing, reselling or automated access, as described in section 16.
4. What we sell, and what we do not
What you get
The Service is a self-study practice tool for people preparing for the Massachusetts, Tennessee, South Carolina and Pennsylvania insurance producer licensing exams, including the Life and Accident and Health exams. Your account is for the state you choose when you sign up, and it only includes products for that state. Depending on what you buy, it may include:
- original practice questions with explanations,
- timed practice exams,
- progress tracking.
The exact contents of each product are described on the product page at the time you buy.
What the Service is not
- Not affiliated or endorsed. Prep Retention is independent. We are not affiliated with, endorsed by, sponsored by, or approved by Pearson (including Pearson VUE and Pearson Professional Assessments), PSI Services LLC, the Massachusetts Division of Insurance, the Tennessee Department of Commerce and Insurance, the South Carolina Department of Insurance, the Pennsylvania Insurance Department, the Kansas Insurance Department, the Idaho Department of Insurance, the Hawaii Insurance Division, or any other government agency, regulator or exam provider. Pearson and PSI names and marks belong to their owners. We use the Pearson and PSI names only to describe who gives the exam you are preparing for.
- Not an approved course. The Service is not an approved pre-licensing education course and not an approved continuing education course. It is not licensed or approved by the Massachusetts Division of Occupational Licensure, the Tennessee Higher Education Commission or the South Carolina Commission on Higher Education. It is practice material only.
- No certificate. We do not issue any certificate, diploma, credential, credit or proof of completion. Using the Service does not count toward any licensing requirement.
- Not the real exam. Our questions are created by us. They are not questions from any real licensing exam, and they are not a copy of the exam. The official exam content outline and the rules of the exam provider and your state's insurance regulator (the Massachusetts Division of Insurance, the Tennessee Department of Commerce and Insurance, the South Carolina Department of Insurance, the Pennsylvania Insurance Department, the Kansas Insurance Department, the Idaho Department of Insurance or the Hawaii Insurance Division) always control. Check those official sources for current requirements.
- No guarantee of results. We do not guarantee that you will pass any exam, get a license, or get any job. Results depend on many things we do not control, including your own study and the exam itself. Results vary from person to person.
- Not professional advice. Nothing in the Service is legal, tax, financial or insurance advice for your own situation.
We work to keep content accurate and current, but insurance laws, rules and exam outlines change, and mistakes can happen. If you find an error, please report it (section 11).
5. Your license to use the content
When you buy access, we give you a personal, limited, non-exclusive, non-transferable license to use the Service for your own exam study during your access period. This license ends when your access period ends, when a refund is issued for that purchase, or when your account is closed as described in section 16. We will not end it for any other reason.
You may not:
- copy, screenshot, photograph, screen-record, download in bulk, scrape, crawl or harvest questions, answers or explanations, by hand or with any tool, bot or script;
- share, post, publish, sell, resell, rent or give away any content, or your account or login;
- use the content to build, train or improve any other product, question bank, dataset or AI model;
- remove any copyright or other notices; or
- get around any access limit or security feature.
Normal personal use, like reading on screen and writing your own study notes in your own words, is fine.
Account tag and monitoring. Each paid question shows your first name and a short account code, so a copy or screenshot shows which account it came from. We watch for unusual use, such as opening questions faster than a person can read them or reaching daily limits again and again. If it keeps happening, we send a friendly reminder email. Copying, screenshotting, recording, sharing or reselling questions or explanations, or sharing your login, breaks these Terms and may end your access without a refund, as described in section 16.
6. Access period
Your purchase gives you access for 180 days from the date of purchase, unless the product page says something different at the time you buy. The access period for your purchase is shown on the product page and in your purchase confirmation.
We may update, add or remove individual questions to keep content accurate, and we may improve or change how features look and work. We will not take away, or put new limits on, the main features you paid for during your access period, including any usage amount shown on the product page when you bought. If we stop offering the Service before your access period ends, we will give you a refund as described in the Refund Policy.
7. Prices and payment
- All-in price. The price shown on our pricing page is the full price we charge for the product. We do not add fees at checkout. Sales tax, if any applies, is shown at checkout before you pay.
- One-time purchase. Products are one-time purchases. They do not renew automatically, and we will not charge you again unless you choose to buy again.
- Payment processor. Payments are processed by Square. On our checkout page you type your card details into a payment form provided by Square. Square turns them into a one-time payment token, and our server receives only that token, so we never see or store your full card number. Square's own terms and privacy policy apply to its processing of the payment.
- Price changes. We may change prices for future purchases. A price change does not affect a purchase you have already made.
- Chargebacks. If you have a problem with a charge, please contact us first at support@prepretention.com so we can fix it quickly. If a chargeback or payment dispute is filed, we may pause access to the Service for that purchase while the dispute is open. If the dispute is closed in our favor, we will turn your access back on for the rest of your access period. If the dispute ends with the money returned to you, access to that purchase ends, as with any refund. Pausing access does not limit your right to dispute a charge with your bank or card issuer.
8. Refunds
Refunds are governed by our Refund Policy at https://prepretention.com/refunds, which is shown before you buy and is part of these Terms. We will honor it exactly as written.
9. Changes to products
If we make changes to a product, those changes apply going forward. The product page in effect when you bought controls what you are owed for that purchase.
10. Reserved
Reserved.
11. Error reports and feedback
You may send us error reports, suggestions and other feedback. You give us a free, perpetual, worldwide, non-exclusive right to use, copy, change and build on your feedback for any purpose, without paying you or naming you. Do not send anything you do not have the right to share, and never send content from a real licensing exam. We decide whether and how to change our content based on feedback. Once we change our content, the changed content is ours and is our responsibility.
12. Acceptable use
You agree not to:
- break any law or anyone else's rights while using the Service;
- share, request or post real exam questions or other confidential exam content;
- try to access accounts, systems or data you are not allowed to access;
- interfere with or overload the Service, or spread malware;
- use bots, scrapers or other automated tools on the Service (assistive technology such as screen readers, magnifiers and voice control is always allowed);
- harass, threaten or abuse our staff or anyone else; or
- pretend to be someone else, or misstate your connection to anyone.
13. Our intellectual property
The Service, including all questions, answers, explanations, practice exams, text, design, software and the Prep Retention name and logo, belongs to Prep Retention or its licensors and is protected by copyright, trademark and other laws. Except for the license in section 5, these Terms do not give you any rights in it.
14. Copyright complaints
If you believe something on the Service infringes your copyright, please follow our Copyright and DMCA Policy at https://prepretention.com/copyright. We close the accounts of repeat infringers as described in that policy.
15. Disclaimers
To the fullest extent permitted by law:
- We provide the Service as described on the product page and in these Terms.
- We do not promise that the Service will be uninterrupted, error free or free of harmful components, or that any content is complete, accurate or current.
- We disclaim all warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.
Some states do not allow sellers to exclude implied warranties or limit remedies for them in consumer sales. For example, Massachusetts law (M.G.L. c. 106, s. 2-316A) does not allow sellers of consumer goods and services to exclude or modify the implied warranties of merchantability and fitness for a particular purpose, or the consumer's remedies for breach of them. If you live in Massachusetts, or if any similar law applies to you, this section does not exclude or limit those warranties or remedies for you, and the parts of this section that such a law does not allow do not apply to you. This section does not change any promise we make in these Terms, on a product page, or in our Refund Policy. We stand behind those promises.
16. Suspension and termination
- By you. You can stop using the Service at any time and can ask us to close your account by emailing support@prepretention.com. Closing your account does not by itself create a refund. Refunds follow the Refund Policy.
- By us, for a breach. We may suspend or close your account, without refund except where the Refund Policy or the law requires one, if you materially break these Terms, especially sections 5 and 12, or if we must do so to comply with law. Where it is reasonable, we will tell you why and give you a chance to fix the problem first.
- By us, without a breach. If we close your account when you have not broken these Terms, or we stop offering the Service, we will refund you as described in the Refund Policy.
- What survives. Sections 5 (limits on use), 11, 13, 15, 17, 18, 19, 20 and 22 to 24 continue after your account ends.
17. Limitation of liability
To the fullest extent permitted by law:
- Neither we nor our members, managers, employees or agents are liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost income, lost job opportunities, exam fees, or the cost of retaking an exam, arising out of or related to the Service or these Terms.
- Our total liability for all claims arising out of or related to the Service or these Terms is limited to the amount you paid for the Service in the 12 months before the event that gave rise to the claim.
These limits do not apply to any liability that the law does not allow to be limited, such as liability for a willful or knowing violation of a consumer protection law, or remedies for breach of implied warranties where the law (including M.G.L. c. 106, s. 2-316A in Massachusetts) does not allow them to be limited. If the law where you live does not allow a limit in this section, that limit does not apply to you.
18. Indemnity
To the extent permitted by law, you agree to cover our reasonable losses and costs, including reasonable attorney's fees, from any third-party claim that arises because you (a) broke section 5 or section 12, (b) infringed someone else's rights through content you sent us, or (c) broke the law while using the Service. This does not apply to the extent a claim is caused by our own fault. We will tell you promptly about any such claim and let you take part in the response.
19. Disputes
Talk to us first
Most problems can be fixed quickly. Before filing a claim, please email support@prepretention.com with the subject "Dispute", your name, the email on your account, a short description of the problem and what you want. We will reply in writing within 30 days, and where the claim is reasonable, we will make a written offer to resolve it. If we cannot resolve it within 30 days after you contact us, either of us may bring a claim as described below. This step does not take away any right you have under a law that cannot be waived, and it does not shorten any deadline the law gives you.
Small claims court
You may bring an individual claim in small claims court in the county where you live or in Wyoming. We may bring a small claims case against you only in the county where you live. Either way, the claim must qualify for that court.
Other courts
Any other claim must be brought in a state or federal court located in Wyoming, and both of us agree to that court's jurisdiction. However, if the law of the state where you live gives you the right to bring a claim in a court in your home state, you may do so. For example, if you live in Tennessee, you may bring a claim under the Tennessee Consumer Protection Act in a Tennessee court.
These Terms do not require arbitration, and nothing in them stops you from going to court as described above.
20. Governing law
The laws of the State of Wyoming and applicable U.S. federal law govern these Terms, without regard to conflict of law rules. This choice does not take away the protection of any law of the state where you live that cannot be waived by contract. For example, if you live in Tennessee, Tennessee law governs any claim you bring under the Tennessee Consumer Protection Act.
21. Changes to these Terms
We may update these Terms. Each version has a version number and effective date at the top.
- Material changes. If we make a material change, we will tell you by email and on the Service before it takes effect. The next time you sign in, you will be asked to review the new Terms and check a box agreeing to them before you continue. If you do not agree, you can stop using the Service and request a refund under the Refund Policy if it applies.
- Other changes. Minor changes, like fixing typos or updating contact details, take effect when posted.
- Past disputes. A change does not apply to a dispute that arose before the change took effect.
- Past purchases. A change does not reduce the access period or refund rights you had for a purchase made before the change.
22. Severability
If a court finds any part of these Terms unenforceable, that part will be limited or removed only as much as needed, and the rest of the Terms stay in effect.
23. Entire agreement
These Terms, together with our Privacy Policy, Refund Policy, Copyright and DMCA Policy and the product page for your purchase, are the entire agreement between you and us about the Service. If these Terms and a product page conflict about what a product includes, the product page in effect when you bought controls. You may not transfer your rights under these Terms. We may transfer ours to a business that takes over the Service, as long as your rights under these Terms are not reduced.
24. Other terms
- If we do not enforce a part of these Terms right away, we can still enforce it later.
- Neither of us is responsible for delays caused by events beyond reasonable control, such as outages at internet or hosting providers, natural disasters or government action. This does not change your refund rights.
- Headings are for convenience only.
